This Dig Acceptable Use Policy ("Policy"), as we may amend from time to time by posting a new version on this page, supplement the Dig's Terms of Service or any other agreement between you, our customer (“you”) and Dig International Inc. or its affiliates (DBA Dig) (“Company” or "Dig") governing the use of Dig's Services, Website or other products and services (each of the foregoing, the "Agreement"). The Policy applies to your access and use of the Services. Capitalized but undefined terms used in the Policy have the meanings set forth in your applicable Agreement with Dig.

Prohibited Activities

You and your users will adhere to this Policy at all times. You will not use the Services in a manner to:

• Except as expressly permitted in writing by Dig, access, query, interact with, monitor, or retrieve data from the Services by means of any automated tools or mechanisms, including without limitation: bots, spiders, scrapers, crawlers, data-mining tools, scripts, automation frameworks, generative AI agents, or any other non-human method of interaction.

• Sell, resell, rent, lease, sublicense, assign, transfer, distribute, or otherwise make available the Services or any Output, or any Dig Data to any third party, whether in whole or in part, without the Dig’s prior written consent.

• Conduct, any load testing, stress testing, performance benchmarking, volume testing, or other activities intended to evaluate or impact the capacity, stability, or performance of the Services or Website without the Dig’s prior written approval.

• Facilitate or encourage any illegal, fraudulent, or abusive activities or materially interferes with the business or activities of Dig or harm any of its users;

• Upload to the Services, use or share any materials that: (a) infringe any intellectual property or other proprietary rights of any party; (b) you do not have a right to upload, share or modify under any law or under any contractual or fiduciary relationship;

• Engage in spam, including but not limited to sending of unsolicited or unauthorized messages, advertising, promotional materials, or any other form of unpermitted solicitation, including activities that violate the Controlling the Assault of Non- Solicited Pornography and Marketing (CAN-SPAM) Act;

• Use the Services or Website to create or transmit any material or content that facilitates or encourages defamatory, discriminatory, or otherwise malicious or harmful speech or acts to any person or entity, including but not limited to hate speech;

• Use the Services to exploit vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behaviour of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm; or

• Use the Services for fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation.

Enforcement of this Policy, including the determination whether a violation occurred, is at Dig's sole and absolute discretion, and failure to enforce it in one instance does not constitute a waiver to enforce the Policy in other instances. You will promptly cease use of the Services in any manner violating this Policy, and Dig has the right to promptly suspend, remove or delete any violating or infringing content from the Services in its sole discretion, or modify the Services and Website to ensure compliance with this Policy.
